Terms and Conditions – Purchasing goods
ShoppingBank (www.shoppingbank.com; "the Site") is wholly owned and operated by Directory Technologies Limited (DTL). This Agreement is a legal document which sets out your rights and obligations, and those of Directory Technologies Limited in relation to this website. Use of our website and the sale and purchase of goods from the website are governed by our terms and conditions as set out below. "We" or "Our" or "Us" means Directory Technologies Ltd trading as ShoppingBank. "You" or "your" means the person accessing, using, registering or ordering from our website. By using the site, you acknowledge that you have read, understand and agree to be bound by all its terms and conditions. You also acknowledge that you have read and understand the Privacy Policy. If you do not agree to these terms, you should not use or access the site. Please note that these Terms and Conditions may be updated from time to time without notice and contain legal obligations so please read them carefully. Your continued use of any part of the ShoppingBank site following the posting of changes to the Terms or the Privacy Policy will mean that you accept those changes. These terms and conditions were last updated on 01/10/2009.
1.1. Disclosed agent
ShoppingBank acts as agent in the sale of goods which are supplied by our fulfilment retailers directly to you. The contract of sale then exists between you and the retailer.
These terms and conditions cover all sales made through this website and each of our retailers must comply with our terms and conditions of trading as detailed in Section 5.
1.2. Prices, description and availability of goods
All prices are shown in GBP (Pounds Sterling). Prices other than those in GBP are shown for guidance purposes only.
All goods are sold subject to availability.
Both price and availability information is subject to change without notice, hence any subsequent purchases of the same product cannot be guaranteed at the same price.
Where goods are temporarily out of stock we will endeavour to contact you so that you may choose between a refund on the item, having it shipped when it is back in stock or selecting an alternative product.
Whilst we take the utmost care to ensure the product descriptions, images, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions.
Despite our best efforts, a small number of the million plus items displayed on our site may be mispriced.
No contract exists between you and our retailer partner for the sale, until our retailer partner accepts the order by taking payment for the goods.
Our retail partners aim to verify prices as part of their payment processing procedures.
Orders are accepted at our retail partners' sole discretion and we and our retailer partners maintain the right to decline orders without giving an explanation.
Colours may vary slightly from those shown on the website due to the limitations of Internet technology.
1.3. Sales tax
Value Added Tax (VAT) is calculated on shipping destination. It is included in the price for orders shipped to destinations within the European Union (EU). For orders shipped to destinations outside the EU the price excludes VAT but orders may be subject to local sales tax or import duty. These are not included in our prices and customers remain liable for payment of these taxes or duties on or following delivery.
Orders shipped outside the EU but paid for with a card registered to an address within the EU are subject to VAT. This VAT will not be displayed in the shopping basket but will be added to the amount charged to your card.
1.4. Payment methods
All orders must be paid for by credit or UK debit cards.
Unfortunately, we do not accept payment by cheque or postal order, and you cannot pay in instalments.
All our retailers accept Visa (including Delta) and Mastercard. Some also accept American Express, Maestro, Solo, and Eurocard. You can find out which cards a retailer accepts by adding the product to the basket, proceeding to checkout, and viewing the drop down 'card type' menu.
All prices are in pounds sterling (£) and credit / debit card transactions for orders outside the UK will be converted by the card company at their current exchange rates.
When ordering from more than one retailer you will see individual transactions for each retailer on your card statement.
1.5. Delivery arrangements
Your shopping basket displays the goods you have purchased, the retailer who will supply them, and an indication of the delivery timescale. We will notify you if your goods are not able to be despatched within this timescale, e.g. some made to order goods may take longer. The delivery costs for each retailer vary and are shown depending on the shipping destination and the delivery service selected. Any delivery times quoted are estimates, based on availability and normal delivery time in working days.
Please note that there are some products that we do not ship to certain destinations, which will be indicated in the shopping basket.
1.6. Cooling off period and cancellation / returns
We want you to be satisfied every time you shop with us. If for any reason you are unhappy with the goods purchased you may cancel your order and return the goods to the retailer within 7 working days from receipt of the goods, you will receive a refund within 30 days of cancellation.
It is your responsibility to take care of the goods before returning them, and they must be returned in a state where they can be resold.
This does not affect your statutory rights as a consumer.
We will not accept the return of:
Fresh / disposable / perishable goods (e.g. flowers or fresh foods)
Sealed audio / video / DVD recordings or computer software which have been opened
Goods made to the customer's personal specifications
Pierced earrings / body jewellery
Bulk orders are only returnable at the retailer’s discretion.
Most retailers will provide returns information in with the delivery note/invoice. Where you wish to return goods and do not have returns information, you can contact customer care for the returns address of the particular retailer(s) you ordered from. Whichever way, it is vital that you enclose a covering letter with the return detailing your name, full address, order number and reason for return (please also specify whether you require an exchange or refund).
We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt.
Unless the goods are defective, damaged or not as specified on your order acknowledgement, you are responsible for the cost of returning goods to the retailer.
If the goods are faulty then the postage costs will be refunded.

We take the utmost care to ensure that no material likely to give offence or which is unsuitable for children is displayed on our website. There are, however, certain products that we sell which are unsuitable for children (e.g. Certificate 18 or 15 videos / DVD's). By placing an order for products with age restrictions you declare that you are of legal age to purchase those products.

All third party copyright, trademarks, brand names, product names and titles on this website are acknowledged.
This website is protected by Copyright and the Copyright, Trademarks, logos and Intellectual Property rights for the content of the ShoppingBank website are the property of DTL. ALL RIGHTS RESERVED.
Any use, printing or copying of materials on this website, other than in the course of browsing, selecting products and ordering from us, is strictly prohibited.
Any framing of this website is prohibited.
1.10. Legals
The contract will be governed by the laws of England and Wales and you agree to submit to the jurisdiction of the English courts.
These terms and conditions do not affect your statutory rights as a consumer.

Terms & Conditions – ShoppingBank Cashback Scheme
Currently the ShoppingBank Cashback scheme is only available to people with a valid UK Bank Account.
In order to earn your Cashback, it is vital that you use the same email address to checkout in ShoppingBank.com that you use to log in to MyShoppingBank.com.
2.1. How Cashback works
ShoppingBank has direct relationships with retailers with whom we have negotiated commission rates. We receive an amount of commission from the retailer for generating the transaction and we pass a significant proportion of that amount on to you once we have received it.
This is unlike the vast majority of other "cashback" schemes, which use affiliate links that are available to anyone.
You do not pay a higher price buying the product from ShoppingBank than if you buy the product directly from the retailer’s own website.
ShoppingBank has approx 1 million products from approx 1,000 UK retailers. You can purchase products from more than 1 retailer in 1 single transaction. The total Cashback amount for your transaction will be shown on the first page of the checkout process.
Remember that when you make a purchase within ShoppingBank.com, you must use the same email address as your MyShoppingBank.com log in.
The ShoppingBank website offers access to numerous third party web pages and content available over the Internet, including links that take you to the retailers own website. Purchases made directly with our retailers are not eligible for Cashback, you must use the ShoppingBank.com checkout process (you may of course visit the retailer’s website for more information and return to ShoppingBank to make your purchase and earn your Cashback).
Your total Cashback earnings to date are displayed on your logged in home page of MyShoppingBank.com.
2.2. The legal stuff
Any offer of Cashback for a transaction is made by ShoppingBank and not by our retail partners. However all matters surrounding the goods or services you purchase are exclusively between you and the retailer.
ShoppingBank is not liable for Cashback not being awarded due to the fact that the user checks out using an email address which is different from his/her MyShoppingBank.com email address. Cashback will only be awarded to the same email address registered with MyShoppingBank.com
Products where Cashback is available are identifiable on MyShoppingBank by our Cashback logo . Under no circumstances does this form a guarantee that you will receive any monetary amount as a result of your transaction.
Although we endeavour to ensure that the amount quoted for each product is accurate, we make absolutely no guarantee that the quoted amount of Cashback at the time of your transaction will be the actual rate paid to you by ShoppingBank. This is due to the fact that our retail partners may alter or withdraw commission rates at short or no notice, and ShoppingBank has no control over this.
In addition to your Statutory Rights, extra terms set by the mechant may apply to any purchases you make. These terms may contain important information relating to the product, which might affect your right to claim compensation or a refund. It is your responsibility to make a note of these and to ask for more details at the time of purchase if necessary.
If you would like to receive a copy of any retailer’s Terms and Conditions, please ask the retailer’s customer service agents.
2.3. Payment Reporting and How you get paid
The estimated amount payable on each transaction you make will appear in Your latest earnings activity under the my Cashback overview tab in each member's my Cashback area. You only become eligible to receive an amount as Cashback where we have receipt of the commission relating to your transaction from the retailer.
The possible statuses against each transaction are listed here with their meanings -
Tracked - ShoppingBank has tracked the user transaction but retailer has not yet validated it.
Validated - Retailer has validated transaction and confirms they will pay Cashback on it. This is usually on expiration of the statutory 14-day "cooling off" period.
Declined - Retailer will not pay Cashback on transaction.
Received - Commission payment received by ShoppingBank for the transaction.
Paid - Member's bank account has been credited for transaction by ShoppingBank.
If for any reason a transaction is reversed, cancelled or denied by you or the retailer you will not receive Cashback for that transaction. Where for some reason the value of a transaction or commission amount is modified by a retailer the revised amount will become your entitlement. If a member believes the declined transaction has been reported by the retailer incorrectly they can query this by emailing customer.care@shoppingbank.com
We make our Cashback payments once a month by BACS (Bankers' Automated Clearing Services) or FPS (Faster Payments Service) on the last working day (Monday to Friday excluding Bank Holidays) of each month. A payment will only be made to members with accounts in good order that have a balance due to them of £25 or greater. The balance due is calculated by totalling the Cashback amounts of all transactions with a status of Received.
For economic reasons, BACS and FPS are the only payment methods used and it is your responsibility to ensure you have the complete and correct bank details registered in the My Payment Details under My Profile. Any BACS or FPS payments that fail due to missing or incorrect information will be rolled over to the next month's payment run.
2.4. Your Account
When you use the MyShoppingBank website, you are responsible for maintaining the confidentiality of your account and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use the MyShoppingBank website only with involvement of a parent or guardian.
For your account to be considered in good order the following conditions must be met:
You must have a valid UK Bank Account with the ability to accept BACS or FPS receipts.
You must only have a single member account at MyShoppingBank and that account must only be being used for transactions personal to you. You may not use your MyShoppingBank account for purchases made on behalf of other people.
Your account has not been, or is not associated or involved with any form of activity we consider to be abusive, fraudulent or otherwise damaging to the business we carry on.
You and your account must not have been involved with spamming or any other activity of a nature where you have caused ShoppingBank links to be published external to the ShoppingBank site for financial gain.
We have not otherwise determined that your account is invalid.We may at our absolute discretion, summarily terminate your account where we reasonably suspect that your account is not in good order. We may also, at our absolute discretion, forfeit all accrued earnings associated with you or your account/s.
We conduct regular reviews of all ShoppingBank accounts. Where an account appears to be in our opinion inactive, we will attempt to contact you and may at our discretion terminate the account. Accrued earnings will be forfeited.
Terms & Conditions - Social Shopping (MyShoppingBank)
3.1. Registration
You will need to register on MyShoppingBank to use some of ShoppingBank's services or features. From time to time, we may change the registration requirements. When you register as a member, you are required to provide information about yourself that is true, accurate, current and complete. You may also want to view our Privacy Policy.
As part of the registration process, you will be asked to choose a username and password. You will be responsible for all activities that occur under your username. You will also be responsible for keeping your password secure. In some cases, we may refuse to grant you a username; we may make this refusal on the grounds that your username is one that impersonates someone else, is or may be protected by trademark or proprietary rights law, or is offensive, rude or otherwise inappropriate, as determined by us in our sole discretion.
3.2. Eligibility
You must be 14 years or older to use the ShoppingBank site. By registering to become a member of ShoppingBank, you acknowledge that you are 14 years of age or older and that you have the capacity to understand, agree to and comply with these Terms of Service.
3.3. Copyright and trademarks
You may not copy, use, or retransmit anything from or for our site without our permission. Any commercial or promotional distribution, publishing or exploitation of the ShoppingBank site, or any content, code, data or materials on the sites is strictly prohibited. You may not offer goods for sale or use the ShoppingBank site for commercial service without our prior written consent.
The images and text referenced, made accessible or made available to you on these pages or by means of the ShoppingBank site are protected by the copyright and trademark laws of the United Kingdom and other countries. Should you wish to use them for any purpose other than viewing on the web, you may need to obtain authorisation from the owner of such materials. It is your responsibility to obtain any authorisations to use an image or text that may be required; ShoppingBank cannot give you such authorisation.
You are not allowed to post or distribute any material you do not own or which you do not have permission to use. Ignoring this policy may result in copyright, trademark, or other intellectual property rights violations.
3.4. Social networking; user content
Should you choose to post material to any forums or other community boards offered on the ShoppingBank site, or if you upload photographs, audio or video files, you will be solely responsible for all content. This content includes messages, text, files, images, graphics, photos, audio clips, sounds, video or other materials. You agree that the content you post will be both true and accurate, will not defame any person or invade their privacy, and will not infringe the proprietary rights of any person. You agree not to post content to which you do not own the rights.
When you post content to the site, your ShoppingBank username is visible to other users. If you choose to post personal information online that is accessible to the public, you acknowledge that you may receive unsolicited messages from other parties. You also acknowledge that visitors to the site may post comments about your messages or content which may be derogatory and that ShoppingBank has no obligation to monitor or delete any such content.
Please be aware that ShoppingBank cannot and does not monitor all user content; therefore ShoppingBank will not be responsible for user content. ShoppingBank does, however, reserve the right to delete or edit any user content that constitutes obscenity, harassment, or is offensive or objectionable and not in keeping with the site's standards.
Under no circumstances will ShoppingBank be responsible for any inaccuracy or defect in user content posted on our site.
As a ShoppingBank user, you agree not to post or email content:
that is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, libelous, invasive of another's privacy, or harmful to minors in any way;
that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
that includes personal or identifying information about another person without that person's explicit consent.
that is false, deceptive, misleading, deceitful, or impersonates any person or entity;
that contains your own or a third party's advertising, branding or promotional content;
that infringes any proprietary rights, including copyright, of any party, or postings that you do not have a right to make available;
restricts or inhibits any other user from using and enjoying the ShoppingBank sites or the services offered on them.
that relates to products that are of a sexual or pornographic nature, alcoholic products, tobacco products or other products that are unlawful in any manner.3.5. Limitation of liability
ShoppingBank will use reasonable endeavours to verify the accuracy of any information it places on the site; however it makes no warranties, whether express or implied in relation to its accuracy.
We make no warranty that this website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that this site or the server that supports it are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through this site.
You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of this site and any information provided to or taken from this site by you.
You agree that, except for death and personal injury arising from our negligence, we will not be liable in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with this contract, for any economic losses (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special or indirect or consequential losses in any case whether or not such losses were incurred by that party arising out of or in connection with the provisions of any matter under the Terms of Service.
3.6. Your activity
You use the ShoppingBank site at your sole risk. You agree that you will be personally responsible for your use of this site and for all of your communication and activity on this site. At any time and without notice, we reserve the right to deny you access to this site, or any part of this site. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the Terms of Service, we may deny you access to this site on a temporary or permanent basis. Any decision to do so is final.
3.7. Indemnification
At our request, you agree fully to defend, indemnify and hold harmless ShoppingBank immediately on demand, its officers, directors, agents, affiliates, licensors, and retailers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms of Service by you or any other liabilities arising out of your use of this site, or the use by any other persons accessing this site using your Internet account. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you hereunder.
3.8. Our relationship
No joint venture, partnership, employment, or agency relationship exists between you and ShoppingBank as a result of the Terms of Service or your use of this site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of ShoppingBank, and we shall not be liable for any representation, act, or omission on your part.
If any provision of this Agreement is held to be invalid or otherwise unenforceable by a court or tribunal of competent jurisdiction, that provision will be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this Agreement will continue in full force and effect.
3.9. Entire Agreement
These Terms of Service (as amended from time to time) represent the entire agreement between you and DTL in relation to your use of the site (including its content), and supersedes any other agreement or communications (whether written, oral or electronic) between you and DTL with respect to the website. Any waiver of any term of this Agreement will only be effective if in writing and signed by a party and no waiver by DTL of any right or remedy under these Terms of Service will prevent DTL from enforcing any of its rights or remedies in any other situation where you breach this Agreement.
3.10. Personal Safety
This website, shoppingbank.com, ("the site") permits you to post content to your profile areas and to make contact with other users of the site. The owners and operators of the site cannot be responsible for the information you post or for your safety and security if you arrange to meet another user in person. This section contains some guidance for you to maximise your safety and security while using the site.
We recommend that you do not post any personal information such as your address, phone number or place of work onto any area of the site or any information which may enable other users to identify who you are, where you live or where you work.
Please be careful even when posting information to your private areas of the site as you will not know the identity of those you have authorised to view this area.
Please report any abuse or harassment to us immediately. If you are not sure whether you should report the abuse, then please do so.
Only meet another user of this site if you feel comfortable and safe doing so.
Consider meeting in a populated public place first; for instance, a coffee bar.
Take your mobile phone and do not rely upon the other person to give you a lift.
Consider whether it is appropriate to let a friend know where you are going to be and you may wish to inform the user you are meeting that you will need to 'check in' with your friend.
Privacy Policy
ShoppingBank believes in protecting the privacy of our users' information. Our Privacy Policy is a legal document, which you should read along with our Terms of Service. This Privacy Policy governs the URL http://www.shoppingbank.com and applies only to information collected via the ShoppingBank website. By using, registering or ordering through the ShoppingBank site, you accept our Privacy Policy and consent to the collection and processing of your personal data in accordance with the terms set out in this Privacy Policy.
4.1. The information we collect
During the ordering process, we collect some or all of the following data: your name and address, your contact telephone numbers (to enable us to contact you in the event of a query), your email address, your card details for debit/credit card purchases, confirmation you are over 18 years of age (this is required to ensure inappropriate goods are not shipped to minors). We will confirm your personal details on our acknowledgement of order. You may check, amend or remove your personal details by emailing customer.care@shoppingbank.com or by writing to us.
We also collect personal data that you provide when you register as a member of MyShoppingBank. This information includes your name and email address. You may voluntarily provide personal data by registering information such as your geographical location, your hobbies, interests, or photos, on your personal profile. Your username, departments and associated content, including postings you make to message boards, are displayed on the website. You are under no obligation to provide us with any personal data to visit the website.
ShoppingBank receives and stores information transmitted automatically from your computer when you browse the Internet and use our website. This information includes information from cookies, your IP address and type of browser. Your IP address is the unique address of your computer, which is automatically provided to other computers when your web browser or email application requests a web page or email from those computers on the Internet. We may use IP addresses to analyse trends, administer the website, track user’s movements, gather broad demographic information or for fraud investigation purposes.
4.2. Use and disclosure of information
We use the information we collect about you to process orders and to provide a more personalised shopping experience. We will share the data we collect with our Retailers solely for the purpose of fulfilling your order. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998 under which we are registered. We will not sell, share or rent this information to others other than as disclosed in this statement.
When you register as a member of MyShoppingBank, the information shown on your personal profile is based on preferences set by you. You are also agreeing to automatically 'opt in' to receive emails from us. These emails may include ShoppingBank newsletters and announcements, communications regarding improvements to the website, notices to let you know if someone has invited you to become a friend or join a group, notices of messages or new activity, details about ShoppingBank activity by your friends, and/or other such communications. At any time, you can opt out of receiving these messages simply by changing your preferences in your Profile. If you no longer wish to receive our main ShoppingBank newsletter you can also simply email us at unsubscribe@shoppingbank.com
If you send a message from ShoppingBank to an email address which is not registered on our website, we will not use that email address for any purpose other than to send the email. We do not sell these email addresses, and we do not send them marketing messages.
When you transfer to the site of a retailer, including our partner brands, your shopping activity will take place on their site, and in accordance with their privacy policy and terms of service. ShoppingBank has no control over those policies.
Our fulfilment partner retailers deliver all orders. By ordering goods from the retailer you become one of their customers and the retailer may contact you directly. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. If you have any complaints about correspondence received from any individual retailer please contact us at customer.care@shoppingbank.com
We may pass on your data to third parties who may send you marketing communications that may be of interest to you and to which you have opted in to receive.
Some of the advertisements that appear on ShoppingBank are delivered to you by our advertising partners. We may transfer information about your use of ShoppingBank, such as your IP address and information stored via cookies, to our advertising partners and other third parties. This information may be used to provide advertising, promotions and other products and services based on your interests and activity. If, at any time, you do not want to receive emails from us, please change your account settings on your profile page.
Although we may share aggregated demographic information with our partners and advertisers, this is not linked to any personal information that can identify any individual person. Our advertising and promotions partners do not have access to your name or personal contact information stored by ShoppingBank unless you choose to share it with them. When you interact with or view an advertisement, ShoppingBank does not provide your name or personal contact information to that advertising partner.
We may provide your personally identifiable information and the data generated by cookies and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you. Such third parties will be obligated to use your personally identifiable information solely to provide the services to us.
It may be necessary to share information if we reasonably believe we are required by law to do so. We may be required to co-operate with law enforcement agencies in any official investigation and we may disclose your personally identifiable information to the relevant authorities. We may disclose information in order to investigate, prevent or take action regarding illegal activities including suspected fraud, or to protect the rights and property of ShoppingBank, its affiliates or the public.
In the event of a transfer of ownership of ShoppingBank, such as acquisition by or merger with another company, we reserve the right to transfer your personal information. If an acquiring company should plan to change this privacy policy, we will notify you before this action occurs.
In the unlikely event that we believe that the security of your personal information in our possession may have been compromised, we may seek to notify you of that as quickly as possible via email.
4.3. Surveys & Competitions
From time to time our website requests information from users via surveys or competitions. Participation in these surveys or competitions is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact and demographic information. Contact information will be used to notify the winners and award prizes and may be used to send you marketing or promotional materials where indicated. Survey information will be used for the purposes of monitoring or improving the use and satisfaction of this website.
4.4. Cookies

ShoppingBank is not intended for use by children, especially those under age 14. Children under the age of 14 are not eligible to become members of ShoppingBank.
